Terms of Service

1. Acceptance of terms

By installing Drape from the Shopify App Store, by embedding the Drape widget on your store, or by accessing drapetryon.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the service.

Drape ("we", "us", "our") is built and operated by eCommerce & technology enthusiasts with experience building solutions for Indian and international D2C brands.

2. Description of service

Drape provides an AI-powered virtual try-on widget that merchants embed on their online stores. The widget allows shoppers to upload a photo and see themselves wearing the merchant's garments. The service is available on the Shopify App Store and via direct API access.

3. Account and access

  • You must be the owner or authorised administrator of an online store to use Drape.
  • You are responsible for keeping your API key confidential. Do not share it publicly.
  • We reserve the right to suspend or terminate accounts that violate these Terms or misuse the service.
  • Free plan accounts are limited to 10 virtual try-ons. Once exhausted, the widget ceases to function until a paid plan is activated.

4. Subscription plans and billing

Drape offers monthly subscription plans billed in USD via Shopify's billing system. All payments are processed by Shopify; we do not store your payment card details.

  • Monthly credits: Each paid plan includes a fixed number of virtual try-ons per billing period. Unused credits do not carry over to the next period.
  • Overage charges:Try-ons beyond your plan's monthly allowance are billed per use at the rates specified on the plan selection page, subject to a maximum overage cap per period. These per-use charges are applied via Shopify's usage billing system.
  • Welcome bonus: New paid plan activations receive 10 additional bonus try-ons in their first billing period only. The bonus does not apply to plan changes or renewals.
  • Billing cycle: Your billing period starts on the date your Shopify charge is activated and renews every 30 days on that same date.

4A. Credit packs (non-Shopify merchants)

Merchants not using the Shopify App may purchase virtual try-on credits in advance ("Credit Packs") via PayPal. The following terms apply:

  • No refunds: All credit pack purchases are final and non-refundable. Each try-on consumes AI processing resources that are incurred at the time of generation.
  • No expiry: Credits do not expire. Unused credits remain on your account indefinitely until used or until your account is terminated.
  • Non-transferable: Credits are non-transferable and may not be resold, gifted, or shared across accounts.
  • No cash value: Credits have no cash value and cannot be exchanged for a refund, cash, or any other form of compensation under any circumstances.
  • Termination for breach: If your account is terminated due to a breach of these Terms, any unused credits are forfeited without refund.
  • Price changes: We reserve the right to change the per-credit price for future purchases. Credits already purchased at a previous rate are unaffected.

5. Pricing changes

We reserve the right to change our subscription prices, overage rates, and plan features at any time at our sole discretion. Any price changes will be communicated to existing subscribers with at least 14 days' notice via email or an in-app notification. Continued use of the service after the effective date of a price change constitutes acceptance of the new pricing. If you do not agree to the new pricing, you may cancel your subscription before the change takes effect.

6. Cancellation and refunds

You may cancel your subscription at any time by uninstalling the Drape app from your Shopify store. Billing is managed by Shopify and refunds, if applicable, are subject toShopify's refund policies. We do not provide pro-rated refunds for partial billing periods unless required by applicable law.

For Credit Pack purchases, Section 4A applies. Credit pack purchases are non-refundable.

7. Acceptable use

You agree not to:

  • Use Drape for any unlawful purpose or in violation of any applicable laws or regulations.
  • Upload images that are obscene, defamatory, or infringe on third-party intellectual property rights.
  • Attempt to reverse-engineer, decompile, or extract the underlying AI models or algorithms.
  • Use the service in a way that could damage, disable, or impair its infrastructure.
  • Resell or sublicense access to the Drape API without prior written consent.

8. Intellectual property

Drape and its underlying technology, including the AI models, widget code, and platform, are owned by us and protected by applicable intellectual property laws. You retain ownership of your own product images and any content you upload. By using the service, you grant us a limited, non-exclusive licence to process your images solely for the purpose of generating try-on results.

9. Disclaimer of warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that try-on results will meet your specific expectations.

10. Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost revenue, or loss of data — arising out of or in connection with your use of the service, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claims arising under these Terms shall not exceed the total fees paid by you to us in the 3 months preceding the claim.

11. Third-party services

Drape uses third-party services including AI image processing, cloud storage, Shopify Billing, and infrastructure services. Your use of Drape is also subject to the terms of these third-party providers. We are not responsible for any changes, outages, or policy changes from these providers that affect the service.

12. Termination

Either party may terminate these Terms at any time. We may suspend or terminate your access immediately if you breach these Terms, engage in fraudulent activity, or if required by law. Upon termination, your right to use the service ceases immediately. We will process data deletion in accordance with ourPrivacy Policy.

13. Governing law

These Terms are governed by the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

14. Changes to these terms

We may update these Terms from time to time. The "Last updated" date at the top of this page will be revised accordingly. Continued use of Drape after changes are posted constitutes acceptance of the updated Terms. For material changes, we will provide at least 14 days' notice.
